Dismiss Lungu’s application- Attorney General Kawesha

Attorney General MULILO KABESHA has asked the Constitutional Court to dismiss Former President EDGAR LUNGU’s application for the recusal of three Constitutional Court Judges from deliberating on his case on allegations of potential bias.
Mr. KABESHA has argued that Mr. LUNGU has not demonstrated the potential biasness of the three Judges namely Constitutional Court President MARGARET MUNALULA, her deputy ARNOLD SHILIMI and Justice MAPANI KAWIMBE.
He has also argued that Mr. LUNGU has not adduced evidence on how President HAKAINDE HICHILEMA would be the greatest beneficiary if the three judges do not recuse themselves.
The Constitutional Court is tomorrow set to hear a formal application by former President EDGAR LUNGU where he is seeking the recusal of three judges from deliberating on his Presidential elections’ eligibility case.
This follows the winding up of counter submissions filed in the Constitutional Court by defence lawyers, Attorney General MULILO KABESHA and Petitioner MICHELO CHIZOMBE.
Petitioner, MICHELO CHIZOMBE has also contended that President HICHILEMA is not a petitioner, and would not be the greatest beneficiary if the three judges continue to preside over the petition.
In the main matter Mr. CHIZOMBE has petitioned the Constitutional Court to determine whether or not former President LUNGU was eligible to contest the 2021 General Elections.
