ACC appeals against the acquittal of LUSAMBO
Hannock Kasama
The Anti-Corruption Commission -ACC- has appealed against the acquittal of former LUSAKA Province Minister BOWMAN LUSAMBO.
This is in a case where he was charged with three counts of interfering with witnesses.
The ACC has raised four grounds of appeals.
Among the grounds of appeals, the ACC has argued that LUSAKA Resident Magistrate TREVOR KASANDA erred in law by restricting the acts of interfering with witnesses to threats and bribery.
Further, the ACC has contended that Magistrate KASANDA erred in law by not discounting the evidence of Mr. LUSAMBO as an afterthought.
It was alleged that Mr. LUSAMBO on unknown dates but between February 1, 2022 and April 30, 2022 in LUSAKA with intent to obstruct the due course of justice prevented COSMAS CHALUSA to adduce evidence as a witness before the court of law, pertaining to his proceed of crime cases.
It is further alleged that Mr. LUSAMBO between April 1 and 30, 2022 in LUSAKA with intent to obstruct the course of justice prevented ERNEST SUMANI and MUNDIA MATAA from adducing evidence as witnesses before the court of law.
The witnesses in question were summoned to testify in the matter where Mr. LUSAMBO is charged with possession of properties deemed to be proceeds of crime.
