By Hannock Kasama
The LUSAKA High Court has ordered former Movement for Multi-party Democracy -MMD- faction Secretary General RAPHAEL NAKACINDA to account for 26 MMD vehicles, allegedly gifted to late former party and Republican President RUPIAH BANDA between 2016 and 2019.
The court has also ordered that Mr. NAKACINDA and his former executive members must pay compensation if the ownership of the vehicles in question has been changed.
The Judgment has been delivered by LUSAKA High Court Judge PIXIE YANGAILO.
Judge YANGAILO has also ordered that the MMD must inspect the Road Transport and Safety Agency -RTSA- Data base to ascertain MMD’s vehicles that might have been disposed during the MMD faction tenure.
She has also ordered that the Zambia Police Service must aid the MMD during the exercise.
Judge YANGAILO has also ordered that the MMD Special Account at ZANACO during Mr. NAKACINDA’s tenure must be audited, with a view to restoring to the party any money possibly abused during the tenure of the MMD Faction.
Meanwhile Judge YANGAILO has ruled that the expulsion of Mr. NAKACINDA from the MMD on June 22, 2020 was valid in accordance with article 53 of the party Constitution.
This is in a matter where Mr. NAKACINDA challenged his expulsion from the MMD on June 22, 2020.
