ConCourt schedules ECL swearing-in case

The Constitutional Court has set July 23, 2024 for a scheduling conference in a matter where a Zambian NKULUKUSA KALUSA has petitioned the Constitutional Court seeking an interpretation whether or not former President EDGAR LUNGU and former Vice President INONGE WINA, were duly sworn in 2016.
Mr. KALUSA seeks the Constitutional Court to interpret whether or not it was Constitutional for Mr. LUNGU and Mrs .WINA to be sworn in by another court official other than the then late Chief Justice IRENE MAMBILIMA.
Mr. KALUSA has cited article 105 of the Constitution.
He has sued the Attorney General as the defendant in the matter.
Mr. KALUSA has also asked the Constitutional Court to determine whether the former President did not breach the Constitution by not handing over power to former Speaker of the National Assembly, PATRICK MATIBINI during the 2016 Presidential Petition.
He further seeks the Constitution Court’s determination whether Mr. LUNGU was legally in office during the 2016 Presidential Petition.
Mr. KALUSA has relied on Article 104 sub-article three of the Constitution of Zambia.
This is according to the petition filed in the Constitutional Court on Tuesday.
