Concourt endorses Kalusa’s application

The Constitutional Court has endorsed an application by a petitioner to amend the Originating Summons in a matter where he has sought the Court’s interpretation on whether or not former President EDGAR LUNGU and former Vice President INONGE WINA , were duly sworn-in 2016.
The court has ordered the petitioner NKULUKUSA KALUSA to file the Affidavit in Support of the amended Originating Summon on December 02, 2024.
Further the court has ordered the Attorney General’s Chambers to file a response on December 16, 2024.
Mr. KALUSA filed the application to amend the Originating Summons, subject to Order one rule of the Constitutional Court, Statutory Instrument Number 37 of 2016.
In this matter, Mr. NKULUKUSA seeks the Constitutional Court’s interpretation on whether or not it was Constitutional for Mr. LUNGU and Mrs. WINA not to be sworn-in by the then late Chief Justice IRENE MAMBILIMA, but by any other court official.
Mr. KALUSA has also asked the Constitutional Court to determine whether the former President did not breach the Constitutional by not handing over power to former Speaker of the National Assembly, PATRICK MATIBINI during the 2016 Presidential Petition.
