ConCourt President, Predecessor Subpoenaed

Constitutional Court President MARGARET MUNALULA and her predecessor HILDAH CHIBOMBA are tomorrow expected to testify in the hearing of the complaint against three suspended Constitutional Court Judges.
Justice MUNALULA and Emeritus Justice CHIBOMBA have been subpoenaed by the Judicial Complaints Commission -JCC- to testify in the proceedings.
This follows the conclusion of defence by three suspended Constitutional Court Judges in the hearing conducted in camera yesterday at LUSAKA High Court’s Commercial Division.
The three affected judges are ANNIE SITALI, MUNGENI MULENGA and PALAN MULONDA.
The three Judges were suspended on September 23, 2024 by President HAKAINDE HICHILEMA on the Judicial Complaint Commission’s recommendations.
Meanwhile, the attempt by the three Constitutional Court Judges to wrestle their suspension through Judicial Review failed.
This is on account that the LUSAKA High Court on October 12, 2024 threw out their application for Judicial Review.
A panel of High Court Judges comprising Judges CHARLES ZULU, CHILOMBO MAKA and TWAAMBO MUSONDA ruled that the High Court lacks jurisdiction to hear their application.
