Court throws out Lungu’s appeal
By Hannock Kasama
Former President EDGAR LUNGU has lost his bid to have three constitutional court judges recuse themselves from presiding over his eligibility case.
The three Judges have declined to recues themselves citing lack of merit as the basis of their decision to turn down the application by Mr. LUNGU.
The three who include Constitutional Court President MARGARET MUNALULA, deputy President ARNOLD SHILIMI and MAPANI KAWIMBE have also turned down the defence lawyers’ application for leave to appeal against their decision before a full bench of the Constitutional Court.
The Judges have further ruled that in determining cases judges are protected with the presumption of impartiality as was established in the case of MILINGO LUNGU verse the Attorney General of 2022.
