ECL eligibility case adjourned to this afternoon

The eligibility case involving former President EDGAR LUNGU could not take off this morning, as defence lawyers sought leave to file a formal application for three Judges to recuse themselves.
Attorney General MULILO KABESHA earlier opposed the application to adjourn the hearing.
Mr. KABESHA, accompanied by Solicitor General MARSHAL MUCHENDE, argued that the application for the recusal of the three Judges must not affect the proceedings.
This is in a matter where LUSAKA businessman MICHELO CHIZOMBE has sought the Constitutional Court’s determination on whether or not former President EDGAR LUNGU was eligible to contest the 2021 General Election.
Mr. CHIZOMBE also wants the court to determine Mr. LUNGU’s eligibility for future elections.
He has maintained that the eligibility case of former President must be fully determined because he has raised new Constitutional issues in his petition
Mr. LUNGU’s lawyers have contended the eligibility of their client was endorsed in the DANNY PULE and BAMPI KAMPALASA’s case of 2017.
