Murder Convict Acquitted as Judge Hamaundu Retires

The Supreme Court has quashed the conviction and acquitted 50-year-old Davies Chishala of Luwingu District, who was sentenced to death in 2014 for murdering a friend during a drinking spree.
The judgment was delivered on behalf of other judges by now-retired Judge Evans Hamaundu during a special session held in his honor.
Justice Hamaundu said the trial court erred in law when it convicted Chishala based on the inconsistent testimony of one of the witnesses, who was later declared a hostile witness.
This is in the matter where Chishala was jointly charged with Tony Nyemba for murdering 65-year-old Fredrick Mulamba.
Meanwhile, Chief Justice Mumba Malila said the legacy of fairness and respect for justice that retired Supreme Court Judge Evans Hamaundu built will guide and inspire the court for generations to come.
Dr. Malila explained that in his 29 years in the judiciary, Justice Hamaundu exhibited his commitment to upholding the rule of law.
Attorney-General Mulilo Kabesha said Judge Hamaundu, through his work, contributed positively to the country’s justice system.
And Law Association of Zambia President Lungisani Zulu has described Justice Hamaundu as a justice hunter whose life and career are worth celebrating.
