The Constitutional Court has dismissed an application filed by the Legal Resources Foundation Limited seeking to halt the ongoing recruitment of judges for the Superior Courts.
The Foundation had petitioned the court, arguing that the appointment process to increase the number of Superior Court judges by 20 would cause irreparable harm if a conservatory order was not granted.
In opposing the petition, Attorney General Mulilo Kabesha submitted that the recruitment process was being conducted in accordance with the law. He argued that recruiting more judges to reduce the case backlog is in the public interest, which overrides the concerns raised by the petitioner.
Delivering the ruling, Constitutional Court Deputy Judge President Arnold Shilimi refused to grant the application, stating that the Legal Resources Foundation had failed to meet the requirements for entitlement to an interim conservatory order.
